Floridians:  Beware of Drunk Drivers, particularly when they have no insurance.

Earlier this year a motorcyclist in Key Largo was seriously injured when he was rear-ended in the early morning hours by a drunk driver.  The drunk driver had no insurance whatsoever.
Upon impact, the biker bounced off the hood of the car, struck the windshield and landed on the pavement. Even though he was wearing a helmet, he was critically injured. The Highway Patrol said the other driver was drunk and found an open Miller Lite Tall Boy at the scene of the crash.
The drunk driver was charged with felony drunk driving-serious bodily injury, 2 misdemeanor drunk driving-property damage counts and 1 misdemeanor of possessing marijuana. He was also ticketed for careless driving, having no insurance and driving with an open alcoholic beverage.

Drunk Drivers and Insurance

Unfortunately, in Broward and Miami-Dade Counties there are far too many motorists who fail to purchase any liability insurance for their cars.  This is particularly the case with drunk drivers who frequently have a history of prior problems involving their driving and therefore are refused coverage by insurance companies or they cannot afford to pay their premiums.  The bottom line is that if you have not purchased uninsured motorist vehicle insurance for yourself, then you are driving naked if you are unfortunate enough to be struck by a driver who has no insurance. There simply will be no available insurance coverage to pay for your injuries.
Florida insurance law provides each vehicle owner a simple mechanism to protect yourself from drunk drivers who fail to purchase liability insurance – buy your own uninsured motorist coverage (“UMC”)!  If the motorcyclist in the above accident had purchased UMC on his motorcycle from his own insurance company, he would be able to recover under his own policy.  In the final analysis, the amount of UMC benefits received far outweighs the cost of any additional premium paid for this coverage.
