It is that time of the year where vacationers from all around the world take a break from their everyday lives and travel down to South Florida to soak up some sun. The extra business is great but can take a turn when things don’t go as planned and you end up in court. Carnival Cruise Ship will be back in court after an alleged brain injury took place on their ship. If you or a loved has sustained an injury due to negligence, call a brain injury attorney of Fort Lauderdale to discuss your compensation options.
Travis Simmons of North Carolina filed a complaint on March 15th, 2017 in the U.S. District for the Southern District of Florida against Carnival Corp who also does business as Carnival Cruise Lines. Mr. Simmons is alleging negligence and failure to warn after he says that he suffered a brain injury after being struck on the head by an object thrown by another passenger while traveling on a Carnival cruise.
According to the complaint, the plaintiff alleges that on March 30, 2016, he was struck in the back of the head by a heavy ceramic coffee cup thrown at him from behind by a rowdy youth while on board defendant’s vessel. He alleges he suffered a brain injury and orthopedic injuries that required surgery. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to train security and other employees to supervise rowdy passengers, and failed to keep sufficient numbers of security to keep order.
The plaintiff is represented by Paul M. Hoffman of Hoffman Law Firm in Fort Lauderdale. The plaintiff requests a trial by jury and is seeking judgment from defendant for damages, prejudgment interest, and costs.
